Terms of Use

1. Who we are and what these terms cover. Garden Genius ("we", "us") operates gardengenius.org from the United Kingdom. These terms apply whenever you use the site, whether or not you create an account. By using Garden Genius you agree to them. You can contact us any time at hello@gardengenius.org or through the Help & contact page on the site.

2. The service. Garden Genius creates AI-generated visualisations of home and garden improvements from photos you provide. One image credit is used for each image the AI creates for you, whether that is a first visualisation, another version, or a tweak. Your first visualisation is free, subject to the fair use rules in section 7.

3. Visualisations are illustrations, not plans. Results are an artist's impression generated by AI. They are not a survey, architectural plan, planning-permission document or quotation, and they may show work that is impractical, non-compliant or differently sized in reality. Always confirm feasibility, measurements, boundaries and costs with a qualified professional before starting or commissioning any work. To the fullest extent permitted by law, we accept no liability for decisions made, or work carried out, on the basis of a visualisation.

4. Accounts and guest designs. You can use your free visualisation without signing up; we create a temporary account linked to your browser so your design and any credits you buy are kept together. Adding an email and password converts it into a full account you can use on any device. You are responsible for keeping your password confidential and for activity on your account. You must be at least 18 to make purchases. If you lose access to a temporary guest account (for example by clearing your cookies before adding an email), we may not be able to recover it, so we recommend saving your account promptly after any purchase.

5. Credits, subscriptions and payment. Prices are shown on the Pricing page. Payments are processed by Stripe; we never see or store your card details. Purchased credit packs and extra credits do not expire. Business subscription allowances reset at each monthly renewal and unused allowance does not roll over. Purchased credits are used only after any subscription allowance. You can cancel a subscription at any time from Account & billing; it remains active until the end of the period already paid for and then does not renew. Prices may change, but changes never affect credits you already own, and subscription price changes take effect only from your next renewal after we notify you.

6. Refunds and your cooling-off rights. Credits are digital content supplied immediately: by purchasing, you agree that supply begins as soon as your purchase completes. If you have not used any of a credit pack, you can ask us for a full refund within 14 days of purchase. Once some credits from a pack have been used, the remainder of that pack is not refundable except where the law requires otherwise. Failed generations never consume a credit, so there is nothing to refund when something goes wrong on our side. Subscription cancellations take effect at the end of the paid period rather than by refund. To request a refund, contact us from the email on your account.

7. Fair use of the free visualisation. The free visualisation is intended as one per person. We apply technical limits (including per-connection limits) to stop it being claimed repeatedly, and we may withhold the free credit where our systems detect abuse. Attempting to circumvent these limits, to automate use of the site, to resell access, or to disrupt the service is not permitted and may result in suspension of your account.

8. Your photos and your results. You keep all rights to the photos you upload and, so far as we hold any, we assign to you our rights in the AI images generated for you. You can use your results for any purpose, personal or commercial. You confirm that you have the right to upload each photo you submit, that photos are of property you own or have permission to photograph, and that you will not upload unlawful content or identifiable images of people without their consent. We may remove content that we reasonably believe breaks these rules or the law.

9. What we do with your photos. Each photo is sent once to our AI provider to create your image and stored in your account so you can revisit your projects. We do not use your photos or results to train AI models, and we do not sell them. Full details are in our Privacy Policy.

10. Sharing. If you use the Share feature, the specific image you share becomes viewable by anyone who has the link, on a public page that also invites others to try the service. Only the image you chose is shared. You can ask us to disable any share link at any time via Help & contact.

11. Availability and changes. We aim to keep Garden Genius available and improving, but we do not guarantee uninterrupted service, and features may change over time. If we ever discontinue the service, we will give reasonable notice and, where required by law, refund unused purchased credits.

12. Liability. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory consumer rights. Subject to that, our total liability to you in connection with the service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect losses such as loss of profit, or for the outcome of any building or landscaping work you commission.

13. Changes to these terms. If we make material changes we will update the date at the top of this page and, for significant changes affecting paid features, notify account holders by email or on the site before they take effect.

14. Governing law. These terms are governed by the law of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales. If you are a consumer, you also benefit from any mandatory protections of the law where you live.
